Since our last newsletter from last year we like to provide you with some actual details.

Certificates of Origin

 

Legalization of Certificates of Origin (CoO) had not been any longer necessary than January 2011. It was enough that the document was verified trough the local chamber of commerce, except it was requested by L/C terms or the customer required legalization of the certificate.

 

In April 2013 this decision has been annulled by Libyan authorities. Now they have given different choices how to handle the CoO in future

 

-       The CoO has to be verified trough a chamber of commerce, which

is affiliated to the Libyan chamber of commerce

 

-       The CoO has to be legalized trough the Libyan embassy located in

the country of export shipping or in the country of origin of items.

Last would be difficult from time to time due to reasons, that most

shipments compares more than one country of origin.

 

-       In exceptional cases it is allowed to legalize the certificates of origin

via Libyan embassy outside the country of shipping or origin, if these

embassies are not active or available.

Airfreight to Benghazi and Tripoli

The Turkish Airline is accepting small consignments for Benghazi.

The Royal Air Maroc and Alitalia are working for Tripoli. Please acknowledge that partly the transit
time is very long as the consignments will be transported not directly. It might come to delays.

Air Malta will start on 05.12.2011 to transport 3 times a week cargo to Tripoli.

Lufthansa declares, against their previous announcements, to start again on 19.12.2011 with a regular passenger service to Tripoli on a daily basis.

Emirates Cargo, Buraq Air, Global Aviation and Etihad Cargo are still not working for Libya up to now.

Courier Service

We can offer a courier service to Tripoli, the transit time will be between 3–5 days.

Smaller consignments as well as documents can be offered also by courier to Benghazi . The transit time will be about 7 days.

Certificates of Origin (C.o.O.)

As before it is still sufficient that the C.o.O. only need to be certified by the chamber of commerce.
If required by L/C or the Libyan clients it is no question that we can arrange the legalisation through the Libyan embassy.

Shipping possibilities

The harbours of Benghazi, Tripoli, Misurata and El Khoms are be served now regularly. There are direct departures, also in transhipment via other ports. At the time being we can offer you conventional shipment possibilities as well as Containers and Ro/Ro-service.

Importing of used vehicles into Libya

The limitation of age for used vehicles has been suspended until 31.12.2011 (date of importing) Due to this fact it is now allowed to ship elder vehicles to Libya. If this exceptional regulation will be extended again, is not known to us.

export customs clearance in European harbours

All consignments which are already delivered to the docks will be automatically stopped by the customs authorities. For each consignment a copy of commercial invoice for controlling purposes trough the authorities is required.

The MRNs (export documents for EU-material) must show now the “new” Libyan codes per position:

Code Y920 LY =material and technologies which are not subject to the Libyan
decree (EU) Nr. 24/2011

Code 3LNA LY = confirmation of exporter that the goods are not listed in
weapon embargo § 69q line 1 AWV (foreign economy decree)

The “old” codes, Y901 for dual use as well as 3LNA51 export list , only, if it is required by EZT (electronically customs tariff code).

As before for consignments with value under EUR 1.000,00 there has to be issued a MRN-document

Airfreight to Benghazi and Tripoli

Since mid of September there are several possibilities per week for airfreight to Benghazi.
As the flights are only passenger aircrafts the capacities are limited. If required there will be offered also cargo aircrafts to Benghazi.

The first cargo aircraft to Tripoli is foreseen for mid of October; a regular service to the capital city is planned.

On November 1, 2011 LUFTHANSA will discharge at Tripoli again every day.
Since the aircrafts are only passenger aircrafts the freight capacity is not very high.
The general rule per package is to be understood as max. 120x80x110 cms (lxwxh) / 150 kos.

On forwarding within Libya

Airfreight cargo at Benghazi can be customs cleared and handled through us.
Also we can offer a delivery service within Benghazi and in the eastern parts of Libya.

Courier service (documents/smaller consignments)

At the moment we are working on the re-building of our Libya courier service.
In the beginning we will start with the eastern part via Benghazi.

Parallel to this we will try to reconstruct our courier service for the western parts via Tripoli.

Shipping possibilities

At the time being regular departures to Tripoli, Misurata and Benghazi are possible. Also
it is planned to integrate the harbour of Marsa el Brega into the rotation. For all harbours
conventional cargo and FCL-containers will be accepted.

Loading harbours will be Bremen, Harwich, Rotterdam as well as Antwerp.

Sanctions

The sanctions have been mostly released, from the EU, USA/Canada, the United Nations as well as from the SECO (State secretariat of economic affairs).

Certificates of Origin

For the import handling there is only a certificate of origin required which is certified by a chamber of commerce but it might be that a consignee needs a legalized COO. This has to be clarified before delivery.

We cannot judge how long this method of handling will last.

As per our information several Libyan embassies advised that in future the documents have to be legalized again.

We will keep you advised about the actual situation.

Providing of Visa

As the most Libyan embassies started to work again it is only a question of time, when visa’s
will be provided again, for example for business travellers.

As per our information there is no problem to provide visa’s via Austria.

The Libyan embassy at Berlin is trying to ensure that a normal handling will be possible very soon. This will take time about 1 – 2 weeks.

As per our knowledge there is still an invitation required which is to be handed over to the Emigration office in Libya. From here the permission will be handed further to the relevant embassy.

Sanctions

With effect from Sept. 2, 2011 nearly the complete sanctions against LIBYA have been repealed
by the EU. But this cannot be equated in the whole circumference as the UN sanctions

With the exception of a few the most oil companies can be delivered with cargo again.

Also the sanctions against the Libyan harbour authorities of Tripoli, Misurata, El Khoms,
Marsa el Brega, Ras Lanuf, Zawia as well as Zuwara have been repealed.

In case required, an appropriate list can be placed to your disposal.

Shipping possibilities

At present time it is planned that with effect from mid of September 2011 regular departures can be arranged again. Possibly the discharging harbours will be Tripoli / Misurata / Marsa el Brega as well as Benghazi.

Libyan harbours

As per our investigations the harbours of Tripoli and Misurata are in good condition and can operate. Meanwhile the relevant harbour authorities started to work again.

There is no concrete news about the condition of the harbour of Marsa el Brega.

Now as ever the airports are closed for official cargo aircrafts. As soon here will be a change
the details will be handed over to you.

Customs handling

At the moment it is safe to assume that the customs documents (for examination)
have to be presented to the customs authorities very early.

For the cargo which is still stored at our several warehouses we will contact you in the next days as the export customs documentation has to be updated.

Shipping possibilities to Benghazi / Libya

From July 8 up to July 12, 2011 the vessel “East Castle” has been at the continent for loading
cargo to Benghazi. Loading ports have been Bremen and Rotterdam.

It is planned to arrange a new departure to Benghazi end of July / beginning of August.

Customs handling

Before loading the following documents have been required by our customs authorities:

Permission of BAFA, Export customs document or declaration for bonded Cargo (T1),
copy of commercial invoice as well a letter from the shipping line confirming the harbours of discharge during the actual voyage.

After presentation of these documents all cargo has been released through the customs
authorities within 48 hours.

Issuing of export customs document (ABD)

There is a new regulation:
AN ”ABD” is also required for consignments with a value of under EUR 1.000,00.
If you need we will give you any support in connection with issuing of this customs document.

Certificates of Origin

If not especially mentioned in the Letter of credit Certificates of Origin do not have to be legalized by the Libyan Embassy.
It is sufficient when the document has been certified by the chamber of commerce.

Permission of export through BAFA

Last week we received permission for another oil company in Libya.

Despatch of documents

In case it is not possible to despatch the shipping documents by ship’s mail we can offer you a courier service via Egypt.
At present time there are documents allowed but it seems that small consignments can be handled in future.

The offer for the courier service is only valid for the eastern part of Libya.

Permission of exports through BAFA
(German authorities for economy and export control)

This week we have received the official permission through BAFA for two Libyan oil clients.

At the same time we got the confirmation from the customs authorities at Bremen, that by presentation of BAFA permission and the updated export documentation a dispatch of goods
will be allowed.

Of course in case the exporting companies would be put on the sanction list, the permission would be revoked.

Parallel to these facts we are still waiting for the official approvals for exports via Italy,
United Kingdom, USA as well as Canada. These are already in working but up to now we have
not received them from the competent authorities.

Shipment possibilities to Benghazi / Libya

For mid of June departures are indicated. Break bulk, container and also Ro/Ro should be possible.

Loading possibilities to Tripoli / Libya

There are efforts to serve the harbour of Tripoli by sea but it still seems to be very difficult
at the moment.

At present time we are checking the possibility by truck on overland route via Tunisia to Libya.
There are still some points to be clarified. Certainly we are quite confident that in the near future transportations by truck can be offered.

Loading possibilities from Tripoli / Libya

At the moment we are able to organize transportation of removals/personal effects
by truck from Tripoli and environs to Europe. The first transportations have been handled
meanwhile.

Legalization of documents

Now as ever we are in the position to arrange the legalization of documents. Personal changes could take place very soon. As a result of this the service would be shut down.

Shipment possibilities to Libya

The shipping line Brointermed is still offering a departure end of this month
to Libya. It is planned that a vessel should load at Bremen / Rotterdam / Harwich
before going to Benghazi. Also another departure is foreseen from Italy.

Sloman Neptun is also advising departures to port of Benghazi.

Export–control through BAFA (German authorities for economy and export control)

Condition for shipment of goods is the allowance through this authority in advance.
We already contacted the BAFA to check the possibilities and we got the information that despatch of goods to subsidiary companies in the EU are basically not prohibited, but still need to be checked through the BAFA to get the final allowance from this authority.

Customs handling

Please note that our local customs authorities have stopped all consignments with destination Libya. The release will be given upon presentation of a permission in writing issued by the BAFA.

A working time of at least 2 up to 3 weeks should be taken into consideration before shipment of goods can take place.

Now as ever we have the possibility to arrange the legalization of documents.
There might be an alteration on the basis of the last events.

Shipment possibilities to Libya

The shipping line Brointermed is intending to offer a departure end of April/ beginning of May to Tripoli and another one to Benghazi. Condition for this is enough cargo amount.

The shipping line Sloman Neptun is still planning a departure to Benghazi on 21.04.2011.

At the moment there a no efforts for Ro/Ro vessels.

We were informed by our Maltese agent, that they can offer a possibility to carry human goods
by vessel to Misurata as well as to Benghazi and if needed also to Tripoli. Acceptable is break bulk cargo only which will be inspected at first by NATO for final release.

Airfreight to Tripoli

The situation is still unchanged. Airfreight possibilities can not be offered at present time.
Now as ever as a result of this no despatch of documents per courier is possible at the time
being.

Sanctions against Libyan banks

We received the information from the German Federal Bank that the presentation of
Letter of Credit documents at a listed bank could be permissible. Consequently a payment
could be released (regulation of old contracts) if appropriate conditions will meet the
requirements. In case you need more details please get in contact with us.

Communication with Libya

Now as ever we can confirm that a contact to the western part of Libya by telephone and fax
is possible.

This week we had the first e-mail contact to the eastern part of the country since long time.
It seems that the connection via Egypt is going ahead.

Harbors in Libya

The harbors of Tripoli as well as El Khoms are operationally.

Remark: Only vessels with cargo like food and auxiliary goods/medical goods are
allowed to pass these ports.

The harbor of Benghazi is also working according to our investigation

No details about Misurata /Marsa el Brega as well as Ras Lanuf have been given to us.

Benghazi on April 18, 2011. Condition is enough cargo amount.

Airfreight to Libya

At the moment no possibility is known to us, neither for persons nor for cargo. Upon
taking effect of the no-fly zone the service from Malta to Libya had to be stopped.

As a result of this no dispatch of documents per courier is possible at the time being.

At the moment nearly all Libyan embassies in Europe are closed. Regardless of this
fact we have the possibility to arrange the legalization of documents via our special
contact.

Letters of credit / Legalization of certificates of Origin

According to a new decree of the Libyan government end of January 2011 there are
no longer legalized certificates of Origin required for the import handling, just the
certification by the chamber of commerce is sufficient.

Unfortunately in a lot of letters of credit which have been opened before the new
regulation there is still shown the passage referring the legalization.

In case you have a confirmed letter of credit on hand please contact us if you need
any support in this connection.

Communication with Libya

In the western part of Libya we have the possibility to communicate by fax, normal
phone and mobile radio network.

To the eastern part we have no contact at the moment. We received the information
that they try to lay a line from Egypt to Libya.

End of March the sanctions against Libya in the USA as well in Europe have been
expended.

Please contact your official responsible authorities before dispatch of any goods to proof, if a business connection is permissible at present time.

Shipping options to Libya

Shipping-line Brointermed is presently discharging cargo at Benghazi port with vessel
“Algiers Star”. They are planning to develop a regular shuttle service from Italy.

Furthermore they tried to enter the port of Tripoli this week, but the vessel was stopped, so they had returned their cargo to Italy.

Shipping-line Sloman Neptun is proofing a departure to Benghazi for mid of April with
vessel “Sloman Producer”.

We were informed by the shipping-line MSC, that they will stop their service to Libya for the time being.

Legalization of documents at Libyan embassy

We were informed this week, that the Libyan embassy at Berlin resume to work. That means, from now on we again we are able to arrange legalization of documents, if required. Please note, that the embassy increased their charges for this service.

Insurance


Please notice, that delivered cargo is not insured at our warehouses. Normally your transport-insurance cover an interim-storage of 30 days. These 30 days are meanwhile exhausted.
To be on the safe side, it would be advisable to proof this matter with your insurance company.

If you need any assistance from our side please let us know.

Export Customs Documents

Generally the issued customs documents have a validity of 90 days.

To avoid any kind of inconvenience with your customs authorities, we suggest proofing directly the status of your documents.

According to our information the factories from Sirte Oil Company, Lifeco, AGOCO, Waha Oil Company as well as Zueitina are closed.

At the moment we have a regular telephone contact with Sirte Oil, Zueitina as well as AGOCO. Partially these companies can be reached by fax.

Our establishment in El Khoms is also accessible on the mobile radio network.

According to official statement of the Libyan General People Commitee for Transport and Communication we received the information on March 10, 2011 that the harbour Misurata is closed until further notice. All other harbors (unfortunately not mentioned by name ) should work daily from 07.00 up to 19.00 h.

Whether this is also concerning the harbors of Marsa el Brega, Benghazi and Ras Lanuf is also not known to us.

transportation to Misurata by truck.

Sloman Neptun Line shut down their service to Libya until further notice.

As per own statement MSC as well as CMA/CGM are serving the harbours El Khoms
and Tripoli, in each case with transshipment via Italy or Malta.

Incoterms 2010
As of January 1, 2011 the eighth edition, Incoterms 2010 have effect. The changes therein affect all of the five terms previously listed in section D, which are now obsoleted and replaced with these three: DAT (Delivered at Terminal), DAP (Delivered at Place), and DDP (Delivered Duty Paid). The new terms apply to all modes of transport.
